Terms of Use

These Terms of Use govern your access to and use of the NOAH ClimateGuard platform and Flood Diagnostic Tool, available at climateguard.ca (the "Platform"), and any related services provided by NOAH Intelligence Inc. ("NOAH"). By accessing the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

Use of the Platform

The Platform provides flood hazard scores, resilience assessments, and related climate risk information for properties in supported municipalities. You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

Accounts

Certain features of the Platform require a registered account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to notify NOAH immediately of any unauthorized access.

Informational Purposes

All scores, assessments, and outputs provided by the Platform are for informational and decision-support purposes only. They do not constitute engineering advice, insurance underwriting, financial recommendations, or legal opinions. See our Disclaimer for full details on the limitations of Platform outputs.

Intellectual Property

All content, models, methodologies, and outputs on the Platform — including HydroSim™, the NOAH Climate Resilience Index (NCRI), and all related scoring systems — are the intellectual property of NOAH Intelligence Inc. and are protected by applicable copyright and trade secret law. Nothing in these Terms grants you ownership of any Platform content.

Limitation of Liability

To the maximum extent permitted by applicable law, NOAH shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of or reliance on the Platform or its outputs, including any decisions made based on flood hazard scores or resilience assessments.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Ontario courts have exclusive jurisdiction over any disputes arising from these Terms.

Changes to These Terms

NOAH may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
